Please note the separate information in the data protection declarations on the websites of the facilities, faculties and institutes of the University of Freiburg.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">IV. General information on data processing<\/h2>\n\n\n\n<h3 class=\"wp-block-heading\">1. Scope of processing of personal data<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">We generally only process our users\u2019 personal data to the extent that this is necessary to provide functional websites and our content and services.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">2. Legal basis for the processing of personal data<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">If we obtain the consent of the data subject for processing personal data, Art. 6 (1) (a) of the EU General Data Protection Regulation (GDPR) serves as the legal basis.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If the processing of personal data is necessary for the performance of a task that is in the public interest or is carried out in the exercise of official authority, Art. 6 (1) (e) and (3) GDPR in conjunction with the task-assigning norms of Union or national law serve as the legal basis.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If the processing is necessary to protect a legitimate interest of the University of Freiburg or a third party and the interests, fundamental rights and freedoms of the data subject do not outweigh the first-mentioned interest, Art. 6 (1) (f) GDPR serves as the legal basis for the processing.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">3. Data deletion and storage period<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The personal data of the data subject will be deleted or blocked as soon as the purpose for which they were stored no longer applies. Data may also be stored if this has been provided for by the European or national legislator in EU regulations, laws or other provisions to which the University of Freiburg is subject. Data will also be blocked or deleted if a storage period prescribed by the aforementioned standards expires.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">V.&nbsp;Provision of websites and creation of Logfiles<\/h2>\n\n\n\n<h3 class=\"wp-block-heading\">1.&nbsp;Description and scope of data<br>processing<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Each time our website is accessed, our system automatically records data and information from the computer system of the accessing computer.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The following data is collected:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The IP address of the accessing computer<\/li>\n\n\n\n<li>Date and time of access<\/li>\n\n\n\n<li>Name, URL and amount of data transferred of the requested website or file<\/li>\n\n\n\n<li>Access status (requested file transferred, not found, etc.)<\/li>\n\n\n\n<li>Information about the browser type, version used and operating system of the accessing computer (if transmitted by the requesting web browser)<\/li>\n\n\n\n<li>Website from which the user accessed our website (if transmitted by the requesting web browser)<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The data is also stored in the log files of our system. The IP address is anonymized after the end of the usage process before being stored in the log files. This data is not stored together with other personal data of the user.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">2. Legal basis for data processing<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The legal basis for the temporary storage of data is Art. 6 (1) lit. f GDPR.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">3. Purpose of data processing<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The temporary storage of the IP address by the system is necessary to enable a website to be delivered to the user\u2019s computer. For this purpose, the user\u2019s IP address must be stored for the duration of the session.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The data is stored in the log files to ensure the functionality of the website. In addition, the data is used for technical optimization, to record the number of hits and to ensure the security of our information technology systems.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">These purposes also constitute our legitimate interest in data processing in accordance with Art. 6 (1) (f) GDPR.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">4.&nbsp;Duration of storage<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The data is deleted as soon as it is no longer required to achieve the purpose for which it was collected. If the data is collected to provide the websites, this is the case when the respective session has ended. If the data is stored in log files, this is the case after two weeks. Storage beyond this period is only possible if there is concrete suspicion of attacks on our website and for error analysis.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">5.&nbsp;Possibility of objection<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The collection of data to provide the websites and the temporary storage of data in log files is essential for the operation of the website. Consequently, the user has no option to object.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">VI.&nbsp;Use of cookies<\/h2>\n\n\n\n<h3 class=\"wp-block-heading\">1.&nbsp;&nbsp;General information on the use of cookies<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Our websites use cookies. Cookies are text files that are stored by the Internet browser on the user\u2019s computer system. When a user visits a website, a cookie can be stored on the user\u2019s operating system. A cookie can, for example, contain a characteristic character string that enables the browser to be uniquely identified when the website is accessed again.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">We use cookies to ensure the proper functioning of the website, to improve the accessibility, navigation and presentation of our website and to integrate media from our video portal.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The following types of cookies are used on our websites:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Technically required cookies when using the websites (we need these for the correct display of the websites and the integration of media from our video portal)<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Technically required cookies to manage consents (e.g. consent to use the integrated Google search)<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Cookies from external service providers when using applications embedded on our websites, such as the integrated Google search, after personal consent (these are cookies that are stored directly on the user\u2019s system by the external service providers when the application is used, without the University of Freiburg having any influence on this)<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">With the exception of technically required cookies, the other cookies are only activated with express consent. This consent can be revoked at any time. Some functions of our website cannot be offered without the use of cookies. For these, it is necessary that the browser is recognized after a page change.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">We need cookies for the following applications:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Load balancer (to distribute the load of calls across multiple servers)<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Integrating media from the video portal (session ID and time stamp of video player status)<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">These purposes also constitute our legitimate interest in data processing in accordance with Art. 6 (1) (f) GDPR.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\">2.4&nbsp;Duration of storage, possibility of objection and removal<\/h4>\n\n\n\n<p class=\"wp-block-paragraph\">The storage period of cookies can be found in Table 1 under VI. 2.1<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Cookies are stored on the user\u2019s computer and transmitted from there to our website. Therefore, you as the user have full control over the use of cookies. By changing the settings in your Internet browser, you can deactivate or restrict the storage of cookies. Cookies that have already been stored can be deleted at any time. This can also be done automatically. If cookies are deactivated for our website, it may no longer be possible to fully use all of the website\u2019s functions.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">3. Therefore, as a user, you have full control over the use of cookies. You can revoke your consent at any time by deleting the corresponding cookie in your browser or system.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">4.&nbsp;Cookies from external service providers when using applications embedded on our websites after personal consent<\/h3>\n\n\n\n<h4 class=\"wp-block-heading\">4.1&nbsp;Google-Search<\/h4>\n\n\n\n<p class=\"wp-block-paragraph\">On our website we offer you the option of a comprehensive search in all university portals using Google\u2019s Programmable Search Engine (see X.1. Google Search). If you give your consent, Google will store cookies on your system. Information on data protection and the cookies used by Google can be found in Google\u2019s privacy policy<strong> [https:\/\/policies.google.com]<\/strong>.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">VII.&nbsp;Contact form and email contact<\/h2>\n\n\n\n<h3 class=\"wp-block-heading\">1.&nbsp;Description and scope of data processing<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">There might be a contact form on our website that can be used to contact us electronically. If a user takes advantage of this option, the data entered in the input mask will be sent to us and stored. This data is:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Name<\/li>\n\n\n\n<li>Email Address<\/li>\n\n\n\n<li>Message Content<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">At the time the message is sent, the following data is also stored:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">(1) Date and time of sending<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Your consent to the processing of the data is obtained during the sending process and reference is made to this privacy policy.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Alternatively, you can contact us using the email address provided. In this case, the user\u2019s personal data transmitted with the email will be saved.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The data will not be passed on to third parties in this context. The data will only be used to process the conversation.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">2.&nbsp;Legal basis for data processing<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The legal basis for processing the data via the contact form is your consent in accordance with Art. 6 (1) lit. a GDPR.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The legal basis for processing the data transmitted when sending an email is Art. 6 (1) lit. f GDPR.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">3.&nbsp;Purpose of data processing<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The processing of personal data from the input mask serves us solely to process the contact. In the case of contact via email, this also represents the necessary legitimate interest in processing the data.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The other personal data processed during the sending process serve to prevent misuse of the contact form and to ensure the security of our information technology systems.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">4. Duration of storage<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The data is deleted as soon as it is no longer required to achieve the purpose for which it was collected. For the personal data from the input mask of the contact form and those that were sent by email, this is the case when the respective conversation with the user has ended. The conversation is ended when it can be inferred from the circumstances that the matter in question has been conclusively clarified and no further queries are to be expected. The data is therefore deleted at the end of the year following its receipt.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The additional personal data collected during the sending process will be deleted after a period of seven days at the latest.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">5.&nbsp; Possibility of objection and removal<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The user has the option to revoke his\/her consent to the processing of personal data at any time. If the user contacts us by email, he\/she can object to the storage of his\/her personal data at any time. In such a case, the conversation cannot be continued. In this case, all personal data that was stored in the course of contact will be deleted.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">VIII.&nbsp; Web analysis by Matomo<\/h2>\n\n\n\n<h3 class=\"wp-block-heading\">1.&nbsp; Description and scope of processing of personal data<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Matomo is used on our website to analyze the usage behavior of our visitors.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Matomo is set up so that the IP address is not stored in full (masking two bytes of the IP address). In this way, it is no longer possible to assign the shortened IP address to the accessing computer.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If individual web pages of our website are accessed, the following data is stored:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Two bytes of the IP address of the user\u2019s computer<\/li>\n\n\n\n<li>The URL of the website accessed<\/li>\n\n\n\n<li>The website from which the user accessed the website accessed (referrer)<\/li>\n\n\n\n<li>The subpages accessed from the website accessed<\/li>\n\n\n\n<li>The length of time spent on the website<\/li>\n\n\n\n<li>The frequency of access to the website<\/li>\n\n\n\n<li>The device type used, the operating system, the browser type, the browser version, the screen resolution and the language setting<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Matomo is also set up in such a way that no cookies are set to analyze user behavior.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The data collected by Matomo is stored exclusively on servers of the University of Freiburg. The stored data is not passed on to third parties. This data is not merged with any other stored data, such as that which arises when using other services in connection with the provision of personal data.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">2.&nbsp; Legal basis for the processing of personal data<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The legal basis for the processing of users\u2019 personal data is Art. 6 (1) (f) GDPR.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">3.&nbsp; Purpose of data processing<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">By analyzing the usage behavior of our visitors, we are able to compile information about the use of the individual components of our website. This helps us to continuously improve our website and its user-friendliness.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This is also our legitimate interest in processing the data in accordance with Art. 6 (1) (f) GDPR.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">By anonymizing the IP address and avoiding cookies, the users\u2019 interest in protecting their personal data is adequately taken into account.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">4.&nbsp; Duration of storage<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">In order to be able to analyse the temporal progression and development of usage behaviour, the data is usually stored for two years and then automatically deleted.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">IX.&nbsp; Video portal of the University of Freiburg (VIMP)<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">On our website, videos from the University of Freiburg\u2019s video portal are integrated into individual web pages in order to offer you media-friendly information. When you visit a website with video integration, technically necessary cookies are set. You can find more information about the cookies used under VI. 2. \u201cTechnically necessary cookies when using the websites\u201d.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">X.&nbsp; Collection and processing of personal data when integrating external services after consent<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">To better convey information and make our content easier to find, we integrate third-party services on our website. Below you will find an overview of the services used.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">1.&nbsp; Google-Search<\/h3>\n\n\n\n<h4 class=\"wp-block-heading\">1.1&nbsp; Access to Google Search<\/h4>\n\n\n\n<p class=\"wp-block-paragraph\">On our website we offer you the option of a comprehensive search across all university portals using Google\u2019s Programmable Search Engine. This search function can be accessed on the internal search results page via the \u201cSearch across all university portals\u201d tab.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\">1.2&nbsp; Declaration of consent<\/h4>\n\n\n\n<p class=\"wp-block-paragraph\">After clicking on the tab, you will receive a selection dialog with information on data protection and the option to consent to the search once or permanently (valid for 1 year). If consent is granted once, users must consent again the next time they visit the site. In the case of permanent consent, we store a cookie on your system so that we do not have to obtain your consent again for future searches. For more information about the cookie used, see Section VI. 3. \u201cTechnically required cookies for managing consent\u201d.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\">1.3&nbsp; Data exchange with Google<\/h4>\n\n\n\n<p class=\"wp-block-paragraph\">When consent is given, the previously entered search term is passed on to a Google script, which then returns the results found. The script developed by Google (Google Programmable Search Engine) is integrated unchanged into the search results page by the University of Freiburg. The script enables automated communication (data exchange) with dynamic transfer of data between the page accessed and the Google service.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\">1.4&nbsp; Google\u2019s privacy policy and privacy statement<\/h4>\n\n\n\n<p class=\"wp-block-paragraph\">By agreeing to use Google Search, you agree to the transfer of data to the Google service. This includes the search term you entered and, if applicable, other search parameters. In addition, Google has the option of collecting additional personal data through the integrated script call, such as the IP address of the computer you are using. Please note that Google has different data protection guidelines than the University of Freiburg websites. Die \u201e<a href=\"https:\/\/www.baden-wuerttemberg.datenschutz.de\/wp-content\/uploads\/2020\/02\/DE_Richtlinie-zur-Nutzung-sozialer-Netzwerke-durch-%C3%B6ff.-Stellen-20200205.pdf\" rel=\"noreferrer noopener\" target=\"_blank\">Richtlinie des Landesbeauftragten f\u00fcr Datenschutz und Informationsfreiheit (LfDI) zur Nutzung von sozialen Netzwerken durch \u00f6ffentliche Stellen<\/a>\u201c macht die Absch\u00e4tzung der Folgen der vorgesehenen Verarbeitungsvorg\u00e4nge f\u00fcr den Schutz personenbezogener Daten im Sinne der DSGVO zur Pflicht.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Das&nbsp;<strong>Instagram-Angebot des SFB 1537 &#8211; ECOSENSE selbst<\/strong>&nbsp;l\u00f6st diese Folge aufgrund des nur sehr geringen Umfangs seiner eigenen Datenverarbeitung (siehe dazu die&nbsp;<strong>Datenschutzerkl\u00e4rung zu Instagram<\/strong>) nicht aus. Allerdings haben einige der Postings einen direkten Personenbezug. ECOSENSE achtet daher bei der Erstellung und Ver\u00f6ffentlichung eigener Inhalte darauf, dass neben dem Urheberrecht der Fotos auch die Bildrechte der Abgebildeten ber\u00fccksichtigt werden. Wird in den Beitr\u00e4gen des SFB 1537 Bezug zu anderen Instagram-Nutzer_innen hergestellt (durch Re-Posten oder Erw\u00e4hnen), so werden nur die Daten verarbeitet, die diese selbst und freiwillig angegeben haben (Nutzername und Postings).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Jedoch stellt aus Sicht des SFB 1537 die&nbsp;<strong>Instagramnutzung an sich<\/strong>&nbsp;aufgrund ihrer weitreichenden Auswirkungen, hinsichtlich der Auswertung der Daten durch die Facebook Ireland Ltd., zu der Instagram geh\u00f6rt, zu Werbezwecken und \u00c4hnlichem, eine Verarbeitung mit hohem Risiko dar, f\u00fcr die eine Datenschutzfolgenabsch\u00e4tzung vorzunehmen ist.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Denn durch die Nutzung eines Instagram-Accounts begibt sich der\/die jeweilige Nutzer_in unter die systematische Beobachtung durch Instagram. Hierbei k\u00f6nnen auch sensible Daten wie politische Einstellungen, die sexuelle Orientierung oder gesundheitliche Probleme offenbart werden, die miteinander verkn\u00fcpft und zur Erstellung eines Pers\u00f6nlichkeitsprofils verwendet werden k\u00f6nnen. Auch besonders schutzw\u00fcrdige Personen wie etwa Jugendliche k\u00f6nnen Instagram-Nutzer_innen und damit Betroffene sein. Auch von ihnen k\u00f6nnen durch die Erhebung von Log-Daten sensible Daten erhoben werden, etwa durch die vorher besuchten Webseiten oder die Standortdaten des Nutzers\/der Nutzerin.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Dies gilt umso mehr, als dass Instagram nicht oder nur eingeschr\u00e4nkt \u00fcberpr\u00fcft werden kann. Da die Daten von in Deutschland ans\u00e4ssigen Nutzer_innen nicht innerhalb Deutschlands, sondern in Irland verarbeitet werden, bestehen h\u00f6heren H\u00fcrden f\u00fcr den Zugang zu (gerichtlichem) Rechtsschutz als bei einem in Deutschland ans\u00e4ssigen Unternehmen.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Der SFB 1537 geht insofern davon aus, dass er als \u00f6ffentliche Stelle, die ein soziales Netzwerk zur \u00d6ffentlichkeitsarbeit und zur Bereitstellung allgemeiner Informationen nutzt, eine Mitverantwortung tr\u00e4gt.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Mitverantwortung bedeutet dabei nicht, dass ECOSENSE die Datenschutzkonformit\u00e4t der Produkte von Instagram best\u00e4tigt oder garantiert. Dies kann sie unter den gegebenen Umst\u00e4nden nicht leisten. Mitverantwortung bedeutet vielmehr, dass ECOSENSE sich und anderen die Risiken sozialer Netzwerke bewusst macht. Aktuell sind die sozialen Netzwerke in vielen Punkten aus datenschutzrechtlicher Sicht verbesserungsbed\u00fcrftig. Deshalb werden den Instagram-Nutzer_innen durch Verweise auf die Homepage von ECOSENSE alternative, datenschutzfreundlichere Kommunikationswege aufgezeigt.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Auf die Risiken, die generell mit der Nutzung sozialer Medien einhergehen, werden die Nutzer_innen zudem in der&nbsp;<strong>Datenschutzerkl\u00e4rung<\/strong>&nbsp;des Instagram-Profils des SFB 1537 hingewiesen.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Zu diesen Ma\u00dfnahmen hat sich ECOSENSE in seinem <strong>Nutzungskonzept<\/strong>&nbsp;verpflichtet. Vor- und Nachteile der Instagram-Nutzung werden danach regelm\u00e4\u00dfig unter Einbeziehung der Nutzungsbedingungen von Instagram evaluiert. Diese Evaluierung des Nutzungskonzepts erfolgt j\u00e4hrlich und ber\u00fccksichtigt die Nutzungszahlen und Reichweiten sowie die Zielgruppenstruktur und das Nutzungsverhalten der Netzwerke.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Die Instagram-Nutzung ist damit in ein<strong>&nbsp;Ma\u00dfnahmenpaket&nbsp;<\/strong>(Nutzungskonzept, Datenschutzerkl\u00e4rung, Disclaimer und Netiquette) eingebettet. Die Absch\u00e4tzung der Folgen der Instagram-Nutzung von ECOSENSE stellt sich vor diesem Hintergrund wie folgt dar:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>1. Risikoidentifikation:<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Die eingangs beschriebenen Risiken, die mit einer Nutzung von Instagram einhergehen, bestehen grunds\u00e4tzlich unabh\u00e4ngig von der eigenen Instagram-Nutzung des SFB 1537. Auch wird durch die Postings des SFB 1537 selbst in der \u00fcberwiegenden Zahl der F\u00e4lle kein Bezug zu sensiblen personenbezogenen Daten hergestellt, sondern es werden eigene, sachbezogene Inhalte verbreitet.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Schlie\u00dflich sind die Daten, die durch die Interaktion mit dem Instagram-Profil des SFB 1537 oder anderen Profile verarbeitet werden \u2013 n\u00e4mlich der in den Kommentaren sichtbaren Accountname eines Instagram-Nutzers\/einer Instagram-Nutzerin \u2013 schon \u00f6ffentlich\/ allgemein zug\u00e4nglich\/frei im Internet verf\u00fcgbar.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Jedoch werden sie durch das Erscheinen auf dem Instagram-Profil des SFB 1537 und die Wechselbeziehung einer breiteren\/\u201cspezifischeren\u201c \u00d6ffentlichkeit zur Verf\u00fcgung gestellt und erreichen so unter Umst\u00e4nden eine gr\u00f6\u00dfere Aufmerksamkeit und weitere Verbreitung als ohne diese Interaktion. Auch l\u00e4sst sich so das Interesse an ECOSENSE an der Abonnenten-Eigenschaft oder an regelm\u00e4\u00dfigen Beitr\u00e4gen ablesen.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Durch die eigene Instagram-Nutzung erh\u00f6ht der SFB 1537 also die Menge der Daten, die von Instagram verwendet und ausgewertet werden.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>2.<\/strong>&nbsp;<strong>Risikoanalyse:<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Durch die Erweiterung des Verbreitungskreises und die Vergr\u00f6\u00dferung der Verkn\u00fcpfungsm\u00f6glichkeiten wird die Verarbeitung der Daten f\u00fcr andere Zwecke durch Instagram und eine heimliche Profilbildung beg\u00fcnstigt. Auch kann die Offenheit f\u00fcr Besucher_innen-Beitr\u00e4ge zu nachteiligen gesellschaftlichen Folgen wie unangebrachten oder diskriminierenden Kommentaren oder der Verbreitung sensibler Daten f\u00fchren.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">M\u00f6gen diese Sch\u00e4den sich bei einer Verursachung durch Instagram selbst als wesentlich darstellen, so werden diese durch das Instagram-Profil des SFB 1537 nur in begrenztem Ma\u00dfe erh\u00f6ht. Denn die Daten sind zu einem wesentlichen Teil schon f\u00fcr Instagram verf\u00fcgbar. Insbesondere entsteht durch das Angebot des SFB 1537 kein Zwang, einen Instagram-Account zu erstellen, da gen\u00fcgend alternative Kontakt- und Informationsm\u00f6glichkeiten zum Sonderforschungsbereich bestehen.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Auch sind die Themen Wissenschaft, Lehre, Forschung etc. nur in begrenztem Ma\u00df geeignet, hasserf\u00fcllte Debatten auszul\u00f6sen, sodass die Eintrittswahrscheinlichkeit eines Schadens sehr begrenzt ist.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>3.<\/strong>&nbsp;<strong>Risikobewertung<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Insgesamt ist das durch das Instagram-Profil des SFB 1537 verursachte zus\u00e4tzliche Risiko daher als gering bis mittel einzustufen.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Zudem ist die Durchf\u00fchrung von Abhilfema\u00dfnahmen m\u00f6glich, die das Risiko weiter senken. Ein Gro\u00dfteil dieser Ma\u00dfnahmen liegt in der Verantwortung des Nutzers: Der\/die Nutzer_in kann sich durch verschiedene Einstellungen bis zu einem gewissen Grad sch\u00fctzen, etwa durch das L\u00f6schen seines Browserverlaufs, das Deaktivieren von Cookies, oder die fehlende Standortfreigabe bei der Verwendung von Fotos.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Zudem erm\u00f6glicht die kontinuierliche redaktionelle Betreuung ein Eingreifen bei ehr- oder pers\u00f6nlichkeitsverletzenden Kommentaren bis hin zur Sperrung des Accounts. ECOSENSE hat hier f\u00fcr die Nutzung seines Angebots eine&nbsp;<strong>Netiquette<\/strong>&nbsp;formuliert, auf deren Einhaltung sie bei der Betreuung der Seite achten wird.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>4. Ergebnis<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Die Instagram-Nutzung durch den SFB 1537 ist angesichts der beschriebenen Risiken und verbindlich vorgesehenen Ma\u00dfnahmen vertretbar. Dadurch erzielt LinkedIn im Vergleich zu anderen Karrierenetzwerken, wie zum Beispiel dem \u00fcberwiegend im deutschsprachigen Raum verbreiteten XING, eine gro\u00dfe internationale Reichweite. Es gibt eine kostenlose Basisversion, optional k\u00f6nnen kostenpflichtig Premiumdienste mit Zusatzfunktionen dazu gebucht werden.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">LinkedIn richtet sich vorrangig an F\u00fchrungs- und Fachkr\u00e4fte sowie an allgemein Karriereinteressierte. Die <strong>\u201eRichtlinie des Landesbeauftragten f\u00fcr Datenschutz und Informationsfreiheit (LfDI) zur Nutzung von sozialen Netzwerken durch \u00f6ffentliche Stellen\u201c <\/strong>macht die Absch\u00e4tzung der Folgen der vorgesehenen Verarbeitungsvorg\u00e4nge f\u00fcr den Schutz personenbezogener Daten im Sinne der DSGVO zur Pflicht.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Das LinkedIn-Angebot des SFB 1537selbst l\u00f6st diese Folge aufgrund des nur sehr geringen Umfangs seiner eigenen Datenverarbeitung (siehe dazu die <strong>Datenschutzerkl\u00e4rung zu LinkedIn<\/strong>) nicht aus, insbesondere im Hinblick darauf, dass es sich bei seinen Beitr\u00e4gen haupts\u00e4chlich um ein reines Senden von Inhalten ohne Personenbezug handelt, und bei einem Bezug zu anderen LinkedIn-Nutzer*innen nur die Daten verarbeitet werden, die diese selbst und freiwillig angegeben haben (da es sich bei LinkedIn um ein Karrierenetzwerk handelt, sind neben dem Nutzernamen und Beitr\u00e4gen h\u00e4ufig auch Informationen zu Arbeitgeber und Position zu finden).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Jedoch stellt aus Sicht der Universit\u00e4t Freiburg die LinkedIn-Nutzung an sich aufgrund ihrer weitreichenden Auswirkungen, insbesondere hinsichtlich der Auswertung der Daten durch LinkedIn zu Werbezwecken und \u00c4hnlichem, eine Verarbeitung mit einem hohen Risiko dar, f\u00fcr die eine Datenschutzfolgenabsch\u00e4tzung vorzunehmen ist.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Denn durch die Nutzung eines LinkedIn-Accounts begibt sich der oder die jeweilige Nutzer*in unter die systematische Beobachtung durch LinkedIn. Hierbei k\u00f6nnen auch sensitive Daten wie politische Einstellungen, die sexuelle Orientierung oder gesundheitliche Probleme offenbart werden, die miteinander verkn\u00fcpft und zur Erstellung eines Pers\u00f6nlichkeitsprofils verwendet werden k\u00f6nnen. Auch besonders schutzw\u00fcrdige Personen wie etwa Jugendliche k\u00f6nnen LinkedIn-Nutzer*innen und damit Betroffene sein, wobei diese naturgem\u00e4\u00df eher nicht zur LinkedIn Zielgruppe geh\u00f6rt auch, wenn eine offizielle Anmeldung bereits ab 16 Jahren erlaubt ist. Selbst beim blo\u00df passiven Mitlesen von LinkedIn ohne eigenen Account k\u00f6nnen durch die Erhebung von Log-Daten sensible Daten erhoben werden, etwa durch die vorher besuchten Webseiten oder die Standortdaten des Nutzers oder der Nutzerin.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Dies gilt umso mehr, als dass LinkedIn nicht oder nur eingeschr\u00e4nkt \u00fcberpr\u00fcft werden kann. Da die Daten deutscher Nutzer*innen nicht innerhalb Deutschlands, sondern im nichteurop\u00e4ischen Ausland verarbeitet werden, bestehen h\u00f6heren H\u00fcrden f\u00fcr den Zugang zu (gerichtlichem) Rechtsschutz als bei einem in Deutschland ans\u00e4ssigem Unternehmen.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Die Universit\u00e4t Freiburg geht insofern davon aus, dass sie als \u00f6ffentliche Stelle, die ein soziales Netzwerk zur \u00d6ffentlichkeitsarbeit und zur Bereitstellung allgemeiner Informationen nutzt, eine Mitverantwortung tr\u00e4gt.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Mitverantwortung bedeutet dabei nicht, dass der SFB 1537 die Datenschutzkonformit\u00e4t der Produkte von LinkedIn best\u00e4tigt oder garantiert. Dies kann sie unter den gegebenen Umst\u00e4nden nicht leisten. Mitverantwortung bedeutet vielmehr, dass der SFB 1537 sich und anderen die Risiken sozialer Netzwerke bewusstmacht. Aktuell sind die sozialen Netzwerke in vielen Punkten aus datenschutzrechtlicher Sicht verbesserungsbed\u00fcrftig. Deshalb werden den LinkedIn-Nutzer*innen durch Verweise auf die Homepage des SFB 1537 alternative, datenschutzfreundlichere Kommunikationswege aufgezeigt.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Auf die Risiken, die generell mit der Nutzung sozialer Medien einhergehen, werden die Nutzer*innen in der <strong>Datenschutzerkl\u00e4rung<\/strong> des SFB 1537 f\u00fcr LinkedIn hingewiesen.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Zu diesen Ma\u00dfnahmen hat sich der SFB 1537 in seinem <strong>Nutzungskonzept<\/strong> verpflichtet. Vor- und Nachteile der LinkedIn-Nutzung werden danach regelm\u00e4\u00dfig unter Einbeziehung der Nutzungsbedingungen der LinkedIn Corporation evaluiert. Diese Evaluierung des Nutzungskonzepts erfolgt j\u00e4hrlich und ber\u00fccksichtigt die Nutzungszahlen und Reichweiten sowie die Zielgruppenstruktur und dass Nutzungsverhalten der Netzwerke.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Die LinkedIn-Nutzung ist damit in ein <strong>Ma\u00dfnahmenpaket <\/strong>(Nutzungskonzept, Datenschutzerkl\u00e4rung, Disclaimer und Netiquette) eingebettet. Die Absch\u00e4tzung der Folgen der LinkedIn-Nutzung des SFB 1537 stellt sich vor diesem Hintergrund wie folgt dar:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>1. Risikoidentifikation<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Die eingangs beschriebenen Risiken, die mit einer Nutzung von LinkedIn einhergehen, bestehen grunds\u00e4tzlich unabh\u00e4ngig von der eigenen LinkedIn-Nutzung des SFB 1537. Auch wird durch die Beitr\u00e4ge der Universit\u00e4t Freiburg selbst in der \u00fcberwiegenden Zahl der F\u00e4lle kein Bezug zu personenbezogenen Daten hergestellt, sondern es werden eigene, sachbezogene Inhalte verbreitet.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Schlie\u00dflich sind die Daten, die durch die Interaktion mit dem LinkedIn-Account des SFB 1537 oder anderen Accounts verarbeitet werden \u2013 n\u00e4mlich die Beitr\u00e4ge oder\/und der Accountname eines LinkedIn-Nutzers oder einer LinkedIn-Nutzerin\u2013 schon \u00f6ffentlich\/ allgemein zug\u00e4nglich\/ frei im Internet verf\u00fcgbar.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Jedoch werden sie durch das Erscheinen auf der LinkedIn-Seite des SFB 1537 und die Wechselbeziehung einer breiteren\/\u201cspezifischeren\u201c \u00d6ffentlichkeit zur Verf\u00fcgung gestellt und erreichen so unter Umst\u00e4nden eine gr\u00f6\u00dfere Aufmerksamkeit und weitere Verbreitung als ohne diese Interaktion.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Auch dadurch, dass der SFB 1537 anderen Accounts folgt oder diese ihr, entstehen zus\u00e4tzliche Querverbindungen und Informationen \u00fcber den jeweiligen LinkedIn-Nutzer oder die jeweilige Nutzerin; so l\u00e4sst sich zum Beispiel Interessensgebiete an der Abonnenten -\/Follower-Eigenschaft, regelm\u00e4\u00dfigen Beitr\u00e4gen, Aktivit\u00e4ten und Gruppenmitgliedschaften ablesen.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Schlie\u00dflich werden auch beim passiven Mitlesen der Seite durch die Nutzer*innen-Logdaten durch LinkedIn erhoben.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Durch die eigene LinkedIn-Nutzung erh\u00f6ht der SFB 1537 also die Menge der Daten, die von LinkedIn verwendet und ausgewertet werden.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>2. Risikoanalyse<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Durch die Erweiterung des Verbreitungskreises und die Vergr\u00f6\u00dferung der Verkn\u00fcpfungsm\u00f6glichkeiten wird die Verarbeitung der Daten f\u00fcr andere Zwecke durch LinkedIn und eine heimliche Profilbildung beg\u00fcnstigt. Auch kann die Offenheit f\u00fcr Besucherbeitr\u00e4ge zu nachteiligen gesellschaftlichen Folgen wie unangebrachten oder diskriminierenden Kommentaren oder der Verbreitung sensibler Daten f\u00fchren beziehungsweise als Karrierenetzwerk insbesondere auch in Bezug auf den aktuellen oder k\u00fcnftigen Arbeitsplatz und das Berufsumfeld.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">M\u00f6gen diese Sch\u00e4den sich bei einer Verursachung durch LinkedIn selbst als wesentlich darstellen, so werden diese durch das LinkedIn-Profil des SFB 1537 nur in sehr begrenztem Ma\u00dfe erh\u00f6ht. Denn die Daten sind zu einem wesentlichen Teil schon f\u00fcr LinkedIn verf\u00fcgbar. Insbesondere entsteht durch das Angebot der Universit\u00e4t Freiburg kein Zwang, einen LinkedIn-Account zu erstellen, da gen\u00fcgend alternative Kontakt- und Informationsm\u00f6glichkeiten zum SFB 1537 bestehen.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Auch sind die Themen des SFB 1537 wie zum Beispiel Wissenschaft, Forschung und Veranstaltungshinweise nur in begrenztem Ma\u00df geeignet, hasserf\u00fcllte Debatten auszul\u00f6sen, sodass auch insoweit die Eintrittswahrscheinlichkeit eines Schadens nur sehr begrenzt ist.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>3. Risikobewertung<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Insgesamt ist das durch den LinkedIn-Account des SFB 1537 verursachte zus\u00e4tzliche Risiko daher als gering bis mittel einzustufen.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Zudem ist die Durchf\u00fchrung von Abhilfema\u00dfnahmen m\u00f6glich, die das Risiko weiter senken. Ein Gro\u00dfteil dieser Ma\u00dfnahmen liegt aber in der Verantwortung des Nutzers\/der Nutzerin: Der*die Nutzer*in kann sich durch verschiedene Einstellungen bis zu einem gewissen Grad sch\u00fctzen, etwa durch das L\u00f6schen seines Browserverlaufs, das Deaktivieren von Cookies, oder die fehlende Standortfreigabe bei der Verwendung von Fotos.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Bez\u00fcglich besonders schutzw\u00fcrdiger Personen wie etwa Jugendlichen l\u00e4sst sich erkennen, dass diese in der Regel nicht zur LinkedIn-Zielgruppe geh\u00f6rt. Auch wenn die Anmeldung bei LinkedIn ab 16 Jahren m\u00f6glich ist, richtet sich LinkedIn als Karrierenetzwerk haupts\u00e4chlich an Fach- und F\u00fchrungskr\u00e4fte, die sich aus eigenem Antrieb weltweit miteinander vernetzen m\u00f6chten.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Diese Zielgruppe ist in der Regel deutlich \u00e4lter und im Besitz einer entsprechenden Ausbildung und muss daher selbst zwischen dem beruflichen Nutzen des Dienstes und dem Schutz ihrer Daten abw\u00e4gen. Dennoch ist zu betonen, dass insbesondere bei Business-Netzwerken eine erh\u00f6hte Gefahr von Fake-Profilen und Identit\u00e4tsdiebst\u00e4hlen besteht, da h\u00e4ufig auch das Gesch\u00e4fts-\/Berufsumfeld der LinkedIn-Nutzer*innen detailliert beschrieben ist.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Zudem k\u00f6nnen einige LinkedIn-Praktiken, wie das Vort\u00e4uschen einer Mitgliedschaft von bestehenden Kontakten der LinkedIn-Nutzer*innen und dem eigenst\u00e4ndigen Versenden von E-Mail-Einladungen zum Beitritt von LinkedIn im Bekanntenkreis von LinkedIn-Nutzer*innen f\u00fcr Argwohn sorgen oder sogar der beruflichen Reputation schaden.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Die LinkedIn-Nutzer*innen sollten daher besonders darauf hingewiesen werden, LinkedIn den Zugriff auf Adressb\u00fccher und weitere auch externe Dienste zu untersagen und das automatische versenden von E-Mail-Einladungen zu deaktivieren, da LinkedIn auch Kontakte au\u00dferhalb des eigenen Netzwerkes kontaktiert und deren Daten speichert. F\u00fcr zus\u00e4tzliche Sicherheit kann man dem*der Nutzer*in nahelegen LinkedIn nur vom Desktop aus im Browser zu nutzen und keine LinkedIn-Apps auf seinem Smartphone \/ mobilen Endger\u00e4ten zu installieren.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Als weitere Abhilfema\u00dfnahme erm\u00f6glicht die kontinuierliche redaktionelle Betreuung ein Eingreifen bei ehr- oder pers\u00f6nlichkeitsverletzenden Kommentaren bis hin zur Sperrung des Accounts. Die Universit\u00e4t Freiburg hat hier f\u00fcr die Nutzung seines Angebots eine <strong>Netiquette<\/strong> formuliert, auf deren Einhaltung sie bei der Betreuung der Seite achten wird.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>4. Ergebnis<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Die LinkedIn-Nutzung durch den SFB 1537 ist angesichts der beschriebenen Risiken und verbindlich vorgesehenen Ma\u00dfnahmen vertretbar. Von LinkedIn verarbeitete Daten<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Angaben dar\u00fcber, welche Daten durch LinkedIn verarbeitet und zu welchen Zwecken genutzt werden, finden Sie in der <strong>Datenschutzrichtlinie von LinkedIn<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Bez\u00fcglich der Sammlung, Nutzung und Speicherung personenbezogener Daten, die LinkedIn von LinkedIn Nutzer*innen aus den designierten L\u00e4ndern der DSGVO bereitgestellt werden, haben sich die LinkedIn Corporation und ihre US-amerikanischen Tochterunternehmen (\u201eLinkedIn\u201c) den Grunds\u00e4tzen des EU-US Privacy Shield verpflichtet.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Der SFB 1537 hat keinen Einfluss auf Art und Umfang der durch LinkedIn verarbeiteten Daten, die Art der Verarbeitung und Nutzung oder die Weitergabe dieser Daten an Dritte. Auch hat sie insoweit keine effektiven Kontrollm\u00f6glichkeiten. Ebenso hat der SFB 1537 keine Kenntnis vom Inhalt Ihrer an LinkedIn \u00fcbermittelten Daten und kann keine Ausk\u00fcnfte dar\u00fcber geben, welche Daten \u00fcber Sie durch die Nutzung des Dienstes LinkedIn gespeichert sind.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Mit der Verwendung von LinkedIn werden Ihre personenbezogenen Daten von der LinkedIn Corporation erfasst, \u00fcbertragen, gespeichert, offengelegt und verwendet. LinkedIn \u00fcbermittelt Ihre Daten dabei von den in der DSGVO designierten L\u00e4ndern in die Vereinigten Staaten von Amerika (USA) und zur\u00fcck. Derzeit befinden sich die LinkedIn Datenzentren f\u00fcr die Speicherung der Informationen ihrer Mitglieder in den USA und in Singapur.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">LinkedIn erfasst und verarbeitet neben Ihren freiwillig eingegebenen Daten wie Profil-, Anmelde-, Kontakt- und Kalenderdaten auch zum Beispiel Standort- und Ger\u00e4teinformationen sowie Internetprotokolladressen (IP-Adressen). Mittels Cookies oder \u00e4hnlicher Technologien kann LinkedIn Sie auch au\u00dferhalb der eigenen Dienste und \u00fcber verschiedene Ger\u00e4te hinweg identifizieren.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">LinkedIn erhebt und analysiert Daten der von Ihnen ver\u00f6ffentlichten und hochgeladenen Inhalte, News und Nachrichten sowie Daten von Partnern und verbundenen Unternehmen, wie zum Beispiel von Ihrem Arbeitsplatz\/Ihrer Ausbildungsst\u00e4tte bereitgestellte Informationen, Webseiten oder Dienste Dritter.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">LinkedIn gibt an Ihre personenbezogenen Daten zu verwenden, um Ihnen, unter anderem mithilfe automatisierter Systeme und eigener Schlussfolgerungen weitere Dienste (einschlie\u00dflich Werbeanzeigen) zur Verf\u00fcgung zu stellen und diese so anzupassen, dass sie f\u00fcr Sie und andere relevanter und n\u00fctzlicher sind.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Dazu f\u00fchrt LinkedIn unter Umst\u00e4nden auch Daten intern \u00fcber verschiedene, in ihrer Datenschutzrichtlinie erfasste Dienste, zusammen.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In welcher Weise LinkedIn die Daten aus dem Besuch von LinkedIn-Seiten f\u00fcr eigene Zwecke verwendet, in welchem Umfang Aktivit\u00e4ten auf der LinkedIn-Seite einzelnen Nutzer*innen zugeordnet werden, wie lange LinkedIn diese Daten speichert und ob Daten aus einem Besuch der LinkedIn-Seite an Dritte weitergegeben werden, wird von LinkedIn nicht abschlie\u00dfend und klar benannt und der ist dem SFB 1537 nicht bekannt.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Weiterhin gibt LinkedIn an m\u00f6glicherweise die Dienste Dritter (Partnerunternehmen und externe Dienstleister) zu nutzen, um sie bei der Bereitstellung ihrer Dienste (beispielsweise Wartung, Analyse, Pr\u00fcfung, Zahlung, Betrugserkennung, Marketing und Entwicklung) zu unterst\u00fctzen.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Diese Dritten haben in dem Ausma\u00df Zugang zu Ihren Informationen wie angemessen erforderlich, um die betreffenden Aufgaben f\u00fcr LinkedIn zu erledigen, und sind verpflichtet, Ihre Informationen nicht offenzulegen oder f\u00fcr andere Zwecke zu nutzen.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Sollten Dienste Dritter von LinkedIn f\u00fcr die LinkedIn-Seite des SFB 1537 eingesetzt werden, hat der SFB 1537 dies weder in Auftrag gegeben, noch abgesegnet oder sonst in irgendeiner Art unterst\u00fctzt. Auch werden ihr die bei der Analyse gewonnenen personenbezogenen Daten nicht zur Verf\u00fcgung gestellt. Lediglich bestimmte, nicht-personenbezogene, aggregierte Informationen \u00fcber die Aktivit\u00e4t, also etwa die Anzahl der Profil- oder Link-Klicks auf ein bestimmtes Posting oder die Seite, sind f\u00fcr den SFB 1537 \u00fcber ihren Account einsehbar. \u00dcberdies hat der SFB 1537 keine M\u00f6glichkeit, den Einsatz solcher Dienste auf seiner LinkedIn-Seite zu verhindern oder abzustellen.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Schlie\u00dflich erh\u00e4lt LinkedIn auch Informationen, wenn Sie zum Beispiel Inhalte ansehen, auch wenn Sie keinen Account erstellt haben (zum Beispiel \u00fcber ein \u00d6ffentliches LinkedIn Profil). Bei diesen sogenannten \u201eLog-Daten\u201d kann es sich um die IP-Adresse, den Browsertyp, das Betriebssystem, Informationen zu der zuvor aufgerufenen Website und den von Ihnen aufgerufenen Seiten, Ihrem Standort, Ihrem Mobilfunkanbieter, dem von Ihnen genutzten Endger\u00e4t (einschlie\u00dflich Ger\u00e4te-ID und Anwendungs-ID), die von Ihnen verwendeten Suchbegriffe und Cookie-Informationen handeln.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u00dcber in Webseiten eingebundene LinkedIn-Buttons oder -Widgets und die Verwendung von Cookies ist es LinkedIn m\u00f6glich, Ihre Besuche auf diesen Webseiten zu erfassen und Ihrem LinkedIn-Profil zuzuordnen. Anhand dieser Daten k\u00f6nnen Inhalte oder Werbung auf Sie zugeschnitten angeboten werden.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Dementsprechend verzichtet der SFB 1537 auf die Nutzung solcher Buttons und Widgets auf ihren eigenen Webseiten. Auch wenn es sich bei der LinkedIn Corporation um einen au\u00dfereurop\u00e4ischen Anbieter handelt, ist dieser in den Designierten L\u00e4ndern an die DSGVO gebunden. Dies betrifft zum Beispiel Ihre Rechte auf Auskunft, Sperrung oder L\u00f6schung von Daten.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">M\u00f6glichkeiten, die Verarbeitung und Sichtbarkeit Ihrer Daten zu beschr\u00e4nken, haben Sie in Ihrer Kontonavigation unter dem Punkt \u201eEinstellungen und Datenschutz\u201c unter den verschiedenen dort aufgelisteten Men\u00fcpunkten.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Ber\u00fccksichtigen Sie dabei auch, dass grunds\u00e4tzlich alle Informationen, die Sie in Ihrem Profil angeben, per Voreinstellung \u00f6ffentlich sichtbar sind, das hei\u00dft Mitglieder, die sich in das Netzwerk einloggen, sowie Kund*innen der LinkedIn-Dienste k\u00f6nnen sie sich ansehen. Dies gilt auch f\u00fcr Ihre Aktivit\u00e4ten innerhalb des Dienstes, wie zum Beispiel Kommentare zu Beitr\u00e4gen, \u201eGef\u00e4llt mir\u201c-Markierungen oder die \u201eFolgen\u201c-Funktion. Auch Gruppenmitgliedschaften sind \u00f6ffentlich sichtbar.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Wenn Sie Beitr\u00e4ge teilen, ist standardm\u00e4\u00dfig eingestellt, dass dies \u00f6ffentlich geschieht. In den Optionen k\u00f6nnen Sie die Sichtbarkeit dieser Beitr\u00e4ge auf Ihre Kontakte beschr\u00e4nken. Sie k\u00f6nnen bei LinkedIn in den Einstellungen au\u00dferdem festlegen, ob Sie Ihre Kontaktliste mit allen Ihren Kontakten teilen wollen. Der SFB 1537 empfiehlt allen Nutzer*innen, sich \u00fcber die Verarbeitung ihrer Daten durch LinkedIn zu informieren und ihre Privatsph\u00e4re so gut es geht zu sch\u00fctzen: Dies beinhaltet die Lekt\u00fcre der <strong>Datenschutzrichtlinie von LinkedIn<\/strong>. The University of Freiburg must carry out the rectification immediately.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">3.&nbsp; Right to restriction of processing<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">You can request the restriction of the processing of personal data concerning you under the following conditions:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>if you contest the accuracy of the personal data concerning you, for a period that enables the University of Freiburg to verify the accuracy of the personal data,<\/li>\n\n\n\n<li>the processing is unlawful and you refuse to delete the personal data and instead request that the use of the personal data be restricted,<\/li>\n\n\n\n<li>the University of Freiburg no longer needs the personal data for the purposes of processing, but you require it to assert, exercise or defend legal claims, or<\/li>\n\n\n\n<li>if you have objected to the processing in accordance with Art. 21 Para. 1 GDPR and it has not yet been determined whether the legitimate reasons of the University of Freiburg outweigh your reasons.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">If the processing of personal data concerning you has been restricted, these data \u2013 apart from their storage \u2013 may only be processed with your consent or for the establishment, exercise or defense of legal claims or to protect the rights of another natural or legal person or for reasons of important public interest of the Union or a Member State.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If the restriction of processing has been obtained in accordance with the above-mentioned requirements, you will be informed by the University of Freiburg before the restriction is lifted.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">4.&nbsp; Right to erasure<\/h3>\n\n\n\n<h4 class=\"wp-block-heading\">4.1&nbsp; Obligation to delete<\/h4>\n\n\n\n<p class=\"wp-block-paragraph\">You can request that the University of Freiburg delete the personal data concerning you immediately, and the University of Freiburg is obliged to delete this data immediately if one of the following reasons applies:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The personal data concerning you are no longer necessary for the purposes for which they were collected or otherwise processed.<\/li>\n\n\n\n<li>You withdraw your consent on which the processing is based in accordance with Art. 6 (1)(a) or Art. 9 (2)(a) GDPR, and there is no other legal basis for the processing.<\/li>\n\n\n\n<li>You object to the processing in accordance with Art. 21 (1) GDPR and there are no overriding legitimate reasons for the processing, or you object to the processing in accordance with Art. 21 (2) GDPR.<\/li>\n\n\n\n<li>The personal data concerning you have been processed unlawfully.<\/li>\n\n\n\n<li>The deletion of the personal data concerning you is necessary to fulfill a legal obligation under Union law or the law of the Member States to which the University of Freiburg is subject.<\/li>\n\n\n\n<li>The personal data concerning you were collected in relation to information society services offered in accordance with Art. 8 (1) GDPR.<\/li>\n<\/ul>\n\n\n\n<h4 class=\"wp-block-heading\">4.2&nbsp; Information to third parties<\/h4>\n\n\n\n<p class=\"wp-block-paragraph\">If the University of Freiburg has made the personal data concerning you public and is obliged to erase it pursuant to Art. 17 Para. 1 GDPR, the University of Freiburg shall take appropriate measures, including technical ones, taking into account the available technology and the implementation costs, in order to inform data controllers which process the personal data that you, as the data subject, have requested the erasure by the University of Freiburg of all links to these personal data or of copies or replications of these personal data.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\">4.3&nbsp; Exceptions<\/h4>\n\n\n\n<p class=\"wp-block-paragraph\">The right to erasure does not exist if processing is necessary<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>to exercise the right to freedom of expression and information,<\/li>\n\n\n\n<li>to fulfil a legal obligation which requires processing under Union or Member State law to which the University of Freiburg is subject, or to carry out a task carried out in the public interest or in the exercise of official authority vested in the University of Freiburg,<\/li>\n\n\n\n<li>for reasons of public interest in the area of \u200b\u200bpublic health pursuant to Art. 9 (2)(h) and (i) and Art. 9 (3) GDPR,<\/li>\n\n\n\n<li>for archiving purposes in the public interest, scientific or historical research purposes or for statistical purposes pursuant to Art. 89 (1) GDPR, insofar as the right referred to in Section 4.1 is likely to make the realisation of the objectives of this processing impossible or seriously compromises it, or<\/li>\n\n\n\n<li>to assert, exercise or defend legal claims.<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">5.&nbsp; Right to information<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">If you have asserted your right to rectification, erasure or restriction of processing vis-\u00e0-vis the University of Freiburg, the University of Freiburg is obliged to inform all recipients to whom the personal data concerning you was disclosed of said rectification, erasure or restriction of processing, unless doing so should prove impossible or involve disproportionate expenditure.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">You have the right to be informed by the University of Freiburg about these recipients.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">6.&nbsp; Right to data portability<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">You have the right to receive the personal data concerning you that you have made available to the University of Freiburg in a structured, common and machine-readable format. In addition, you have the right to transmit this data to another controller without hindrance from the University of Freiburg to which the personal data was made available, provided that<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>the processing is based on consent in accordance with Art. 6 (1) (a) GDPR or Art. 9 (2) (a) GDPR or on a contract in accordance with Art. 6 (1) (b) GDPR and<\/li>\n\n\n\n<li>the processing is carried out using automated procedures.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">In exercising this right, you also have the right to have the personal data concerning you transmitted directly from one controller to another, where technically feasible. This must not affect the freedoms and rights of other persons.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The right to data portability does not apply to the processing of personal data necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in the University of Freiburg.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">7.&nbsp; Right of objection<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">You have the right to object at any time to the processing of personal data concerning you which is carried out on the basis of Art. 6 (1) (e) or (f) GDPR, for reasons arising from your particular situation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The University of Freiburg will no longer process the personal data concerning you unless it can demonstrate compelling legitimate grounds for the processing which outweigh your interests, rights and freedoms, or unless the processing serves to assert, exercise or defend legal claims.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In connection with the use of information society services, you have the option of exercising your right of objection by means of automated procedures that use technical specifications, regardless of Directive 2002\/58\/EC.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">8.&nbsp; Right to revoke the declaration of consent under data protection law<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">You have the right to revoke your consent to data protection at any time. The revocation of the consent does not affect the legality of the processing carried out on the basis of the consent until the revocation.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">9.&nbsp; Right to lodge a complaint with a supervisory authority<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Without prejudice to any other administrative or judicial remedy, you have the right to lodge a complaint with a supervisory authority, in particular in the Member State of your residence, place of work or place of the alleged infringement if you consider that the processing of personal data concerning you infringes the GDPR.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The supervisory authority with which the complaint was submitted shall inform the complainant of the status and outcome of the complaint, including the possibility of a judicial remedy under Art. 78 GDPR.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Version 14 \u2013 10.06.2024 I.
