Vöneky, Risk, Rationality, and Regulation – AI and Biotech Regulation in the EU, presentation at the 22nd Jean Monnet Seminar on Advanced Issues of EU Law (“Modern Technologies and EU Law ”), Dubrovnik, Croatia, 06.04.2025. Abstract: Two emerging technologies are at the center of the regulatory debate in the EU. On the one hand, the EU AI Act and its implementation; on the other, the proposals of how to deregulate new genome editing technologies. In both cases, the key issue is how it can be achieved that a powerful technology can be used without the risks outweighing the potential benefits. The presentation examines – in a first step – the EU AI Act and whether or how it proportionally mitigates the risks arising from the development of AI systems. It spells out the rationale of the EU AI Act and shows that there are loopholes, raising the question of whether certain risks should be minimized through alternative regulatory approaches. In a second step, the debate on the deregulation of new genome editing technologies will be briefly addressed. Overall, the presentation aims to illustrate how difficult it is, especially within the EU with its diverse interests of Member States, to regulate scientific and technological progress and what possibilities exist for greater risk-based “adaptability” in future regulations.
